Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of sportswonderful.com (the “Site”) and any services booked through it with Sports Wonderful, LLC (“Sports Wonderful,” “we,” “us,” or “our”). By using the Site or booking a session, you agree to these Terms. If you do not agree, please do not use the Site or book a session.

1. Services

Sports Wonderful provides whole-body EMS (Electrical Muscle Stimulation) training using the miha bodytecยฎ system, offered in-studio or at a client’s approved location (“Mobile EMS”), as well as private and group tennis lessons. Service descriptions, session lengths, and pricing are listed on our Services page and are subject to change at any time without prior notice. Any price changes will not affect sessions already booked and paid for.

2. Eligibility & Health Requirements

EMS training is not appropriate for everyone. Before your first EMS session, you must complete our health screening and liability waiver. Certain medical conditions may require physician clearance before you can participate โ€” see our Client Forms page for details. It is your responsibility to disclose complete and accurate health information; Sports Wonderful is not responsible for outcomes resulting from undisclosed or inaccurate health information.

Clients under 18 may participate in tennis lessons with the consent of a parent or legal guardian, who must complete any required forms on the minor’s behalf.

3. Booking & Payment

  • Sessions may be booked through the Site by selecting a service, date, time, and language.
  • Online payments are processed through PayPal. By providing payment information, you authorize Sports Wonderful to charge the applicable session fee (and any applicable travel fee for Mobile EMS sessions) through our payment processor.
  • Package pricing (such as the 10-session EMS package) must be purchased and used according to the terms stated at time of purchase.

4. Cancellation & Rescheduling Policy

  • We ask for at least 24 hours’ notice to cancel or reschedule a session. Cancellations made with less than 24 hours’ notice, or missed sessions (“no-shows”), may be charged the full session fee.
  • Sessions purchased as part of a package (e.g., the 10-session EMS package) are non-refundable but may be rescheduled in accordance with this policy.
  • Sports Wonderful reserves the right to cancel or reschedule a session due to illness, emergency, or other unforeseen circumstances, and will provide as much notice as possible.

5. Assumption of Risk & Release of Liability

Physical training, including EMS training and tennis instruction, carries inherent risks, including but not limited to muscle soreness, fatigue, dizziness, and injury. By booking and participating in a session, you acknowledge these risks and agree to the terms of our separate Client Health Screening & Liability Waiver, which you must complete before your first EMS session. Nothing in these Terms limits or replaces the specific acknowledgments and releases contained in that waiver.

6. Client Conduct

We ask that all clients arrive on time, follow trainer/coach instructions during sessions, and treat staff and other clients with respect. Sports Wonderful reserves the right to refuse service or end a session early if a client’s conduct poses a safety risk to themselves, staff, or others.

7. Intellectual Property

All content on this Site โ€” including text, graphics, logos, and images โ€” is the property of Sports Wonderful, LLC or its licensors and may not be copied, reproduced, or used without prior written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Sports Wonderful, LLC and its owner, employees, and contractors shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in our services, except as required by law or as separately addressed in our Client Health Screening & Liability Waiver.

9. Third-Party Services

Our booking and payment processes rely on third-party services, including PayPal. We are not responsible for outages, errors, or issues arising from these third-party services that are outside of our control.

10. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved in the appropriate courts located in Illinois.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or booking of services after changes are posted constitutes acceptance of the updated Terms.
